가맹본부는 가맹점사업자조직을 어떻게 대하여야 하는가 - 관계발전을 위한 제언
2013 가맹사업법 개정 이후 가맹점협회가 늘어나고 있으며 이들의 활동도 활발해지고 있다. 가맹점 협회의 확산은 가맹본부가 원하지 않는 변화다. 대다수 가맹본부는 임기응변적으로 대응하거나 마땅한 대응방안이 없어 무대응으로 일관하고 있다. 이는 불필요한 갈등과 불신을 조장하고 관계를 악화시켜 프 랜차이즈 시스템의 성장과 안정을 저해한다. 본 연구는 가맹본부가 가맹점협회를 어떻게 대하는 것이 프랜차이즈시스템의 성장과 관계발전에 바 람직한가를 검토하고 있다. 이를 위해 가맹점사업자조직의 대표적 형태인 가맹점협회와 가맹점자문위원 회의 형성동기와 주체, 운영방식, 대표성, 정체성, 이들 조직에 대한 가맹본부의 태도를 비교기술하고 있 으며, 가맹점사업자조직의 진화과정을 미국의 Subway 사례를 통해 살펴보고 있다. 또한 보다 바람직한 관계발전을 위해 가맹본부와 가맹점사업자조직에 요구되는 노력, 그리고 법·제도상의 개선사항을 제시 하고 있다.

How Should Franchisors Deal With Franchisee Organizations? Suggestions for Building A Better Relationship
Since the amendment of franchise law in 2013, the number of franchisee organizations has increased dramatically in Korean franchise industry. The expansion of franchisee organizations, mostly in the form of independent associations, is an unwelcomed challenge on the part of franchisors. Most franchisors react to the formation of franchisee organizations with no strategic focus or contemplation resulting in unnecessary conflict and distrust that are harmful to franchisor-franchisee relationships and the system growth and stability. This paper examines how franchisors should manage franchisee organizations for the purpose of systems growth and better relationships with franchisees. For this, independent franchisee associations and franchisee advisory council, two typical forms of franchisee organizations, were contrasted with respect to their formation drives, organizational and operational characteristics, representativeness, identity, and the attitude toward the franchisors. The Subway case was also introduced as an illustrative example of the evolutionary progress of franchisee organizations. This paper suggests several strategic guidelines for franchisors, franchisee organizations, and the regulatory agencies.
